HR is responsible for hiring in the workplace. However, the employment laws have gotten so complicated now, that HR must brush up on those employment laws and how they impact hiring in the workplace. HR needs to have a better understanding of the legal issues that can hurt you when interviewing such as what you can lawfully ask a candidate and what questions you should avoid at all costs. What about the job description and using it during the interview to help the candidate better understand the job for which they are applying. What legal considerations do you need to know regarding what the job description should contain. You also need to know whether to conduct a background check and compliance requirements of the Fair Credit Reporting Act. Offer letters also often trip up HR so you need to be aware of what to include in an offer letter and what to avoid. The nightmare of HR’s world is completing the I-9 form so it is important to become more familiar with how to complete it correctly. The EEOC has made clear that it is focused on GINA enforcement and therefore HR needs to have a better handle on the legal requirements of GINA when conducting pre-employment physicals.
